Basic income support according to SGB II

Students are generally not entitled to a citizen's allowance under the Second Book of the German Social Code (SGB II) if their training is eligible for support under the Federal Training Assistance Act (BAföG) and they live outside their parents' household.

Students who live in their parents' household may only be entitled to citizen's allowance if BAföG benefits are paid or not paid only due to the consideration of income and/or assets or if they have applied for BAföG but a decision has not yet been made on their application.

Pupils who are not entitled to BAföG due to a lack of mandatory accommodation away from home (§ 7 Para. 6 No. 1 SGB II) or who attend evening classes and have already reached the age of 45 (§ 7 Para. 6 No. 3 SGB II) may also be eligible.

Entitlement to citizen's allowance is dependent, among other things, on being in need of assistance.

If BAföG and citizen's allowance are received at the same time, students who have not yet reached the age of 25 and are in gainful employment are subject to a basic reduction amount of currently 556 euros when their income is taken into account. The amount is based on the currently applicable low income threshold (§ 8 Para. 1a SGB IV).

Students who are 25 years of age or older have a basic deduction amount of 100 euros when offsetting income. An amount in excess of 100 euros can be taken into account if necessary higher expenses, e.g. for training materials, are proven. However, certain benefits can be paid to students with their own accommodation and other trainees who are not entitled to citizen's allowance, provided that the requirements are met (§ 27 SGB II).

These are the following services:

  • Additional needs in the event of pregnancy, single parenthood, medically necessary cost-intensive nutrition and initial equipment for pregnancy and childbirth, if your own income is not sufficient and you are therefore in need of assistance.
  • in cases of particular hardship, benefits to secure living expenses and accommodation as a loan (for students who have reached the age of 45, also as a grant),
  • Benefits to cover living expenses for the first month of training as a loan.

Students with disabilities can also apply for integration assistance to finance their disability-related additional needs during their studies (e.g. for technical aids and personal study assistants) (§ 112 SGB IX).
